Terms of Service

These Terms of Service are a binding agreement between you and CrustAPI ("CrustAPI", "we", "us", or "our"). They govern your use of crustapi.com and our data API (the "Service"). By creating an account, using an API key, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. CrustAPI is not affiliated with, endorsed by, or sponsored by Google. "Google" is a trademark of Google LLC.

1. Acceptance and Overview

By accessing or using the Service, you accept these Terms and our Privacy Policy, which is part of this agreement. If you use the Service on behalf of a company or other organization, you confirm that you have authority to bind that organization, and "you" means both you and that organization.

CrustAPI is a data API. It returns Google Search results and Google Maps and local-business data as clean JSON or CSV. We are an independent company. We are not affiliated with, endorsed by, or sponsored by Google, and "Google" is a trademark of Google LLC. We may update these Terms as described in the "Changes to These Terms" section below.

2. Definitions

To keep these Terms clear, a few terms are defined here.

3. The Service

The Service lets you send queries to our API and receive Google Search results and Google Maps and local-business data as clean JSON or CSV. Supply behind the API may change over time, but we aim to return one stable, clean schema.

The Service is for business and professional use only. It is a business-to-business product. It is not a consumer or end-user service, and you may not use it for personal, household, or consumer purposes.

4. Accounts and Eligibility

To use the Service you must be at least 18 years old and must use CrustAPI for business or professional purposes. When you create an account you agree to give accurate information and to keep it up to date.

You are responsible for keeping your API Key secret. Anyone who has your API Key can use the Service and spend your Credits. You are responsible for all activity that happens under your account and API Key. If you believe your key has been exposed or misused, contact us at support@crustapi.com so we can help.

You may hold only one free-tier account per person or entity. Do not create multiple accounts to farm free Credits.

5. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own business purposes, subject to these Terms. In using the Service, you agree to the following rules.

6. The Data and How It Is Sourced

CrustAPI collects data from publicly available web pages using its own technology. Third-party content within results, such as business listings, remains the property and responsibility of those third parties. We do not own that content and we are not responsible for it.

The data is provided "as is". We do not warrant that it is accurate, complete, or current, and results may change without notice. You are responsible for deciding whether the data is suitable for your use and for complying with any laws that apply to how you use it.

7. Credits, Billing, and Payment

Pricing is prepaid, top-up Credits. One credit equals one successful result returned. You are billed only for results we return. A search that returns no results is free.

The free tier gives you 3,000 Credits per month, and no credit card is required. Free Credits reset each month and do not roll over. Purchased Credits never expire.

Payments are processed by our third-party payment provider. We do not store your card number or full payment details. That provider handles and stores those. By purchasing Credits, you also agree to that provider's terms as they apply to the payment.

8. Refund Policy

We give a full refund if you request it within 7 calendar days of your first payment and you have used less than 20% of the Credits in that purchase. Otherwise, Credits are non-refundable.

9. Your Data and Privacy

Our Privacy Policy explains what personal data we collect, how we use it, and the choices you have. It is part of these Terms, and you should read it.

We do not sell or rent your personal data, and we do not share it for cross-context behavioral advertising.

10. Intellectual Property

The Service, including our software, website, API, documentation, design, and trademarks, is owned by us or our licensors and is protected by law. Except for the limited right to use the Service granted in these Terms, we do not transfer any of our intellectual property rights to you.

You may not copy, modify, distribute, or create derivative works of our software or website except as allowed by these Terms or by law. Third-party content within results remains owned by those third parties.

11. Disclaimer

The Service and all materials are provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all implied warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that the data will be accurate, complete, or current.

12. Limitation of Liability

To the maximum extent permitted by law, neither party nor our suppliers is liable for any indirect, incidental, special, or consequential damages, or for any lost profits, revenue, or data, arising out of or related to these Terms or the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or related to these Terms or the Service is limited to the amount you paid us in the 12 months before the claim.

13. Indemnification

Each party will indemnify the other against third-party claims that arise from its breach of these Terms or its misuse of the Service. This means that if a third party brings a claim because of something one party did wrong under these Terms, that party will cover the other for that claim, to the extent the law allows.

14. Termination

You may stop using the Service and close your account at any time by contacting us at support@crustapi.com. We may suspend or terminate your account or access to the Service if you breach these Terms, misuse the Service, or use it in a way that creates risk or legal exposure for us or others.

When your account ends, your right to use the Service stops. Unused Credits are subject to the refund policy above and otherwise are non-refundable. Sections that by their nature should survive termination, such as the data terms, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply.

15. Changes to These Terms

We may update these Terms. If a change is material, we will notify you through the site or by email. Continued use of the Service after an update means you accept the updated version. If you do not agree to an update, stop using the Service.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. You agree that any dispute arising out of or related to these Terms or the Service will be brought only in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts.

17. Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms will stay in effect. The unenforceable part will be applied to the greatest extent allowed by law, or removed if that is not possible, and the remaining terms will continue in full force.
